DHS FY 2025 Annual Posting of Buy American Act Domestic Nonavailability Actions

The Department of Homeland Security (DHS) issued this special notice to provide the annual public listing of procurement actions that utilized Buy American Act (BAA) domestic nonavailability waivers during Fiscal Year 2025. This publication aims to promote awareness and public visibility regarding the agency's use of exceptions to the BAA statute. During this period, DHS executed 1,051 contract actions totaling $80,195,215.23, which accounted for approximately 1.87 percent of the agency’s procurement obligations subject to BAA compliance.

The majority of these procurement actions were awarded by the U.S. Coast Guard to acquire spare and replacement parts for equipment of foreign manufacture. These acquisitions included aircraft accessories and components, airframe structural components, helicopter rotor blades, drive mechanisms, tubing, and hardware. These items fall under the class nonavailability determinations at FAR 25.103(b)(1) and 25.104(a) because domestic parts are not available from original equipment manufacturers for the maintenance and service of specific aircraft and other assets.
