NOTICE OF INTENT TO AWARD SOLE SOURCE BLANK PURCHASE AGREEMENT (BPA) SOLICITATION NUMBER: N62271-17-Q-1080 Synopsis: The Government hereby submits a notice of intent to award a 5-year Blanket Purchase Agreement (BPA) for the procurement of Comsol, Inc. published software, licenses, modeling specific products, and maintenance services under other than full and open competition to Comsol, Inc., Burlington, Massachusetts, 01803. NPS research groups and educational platforms have been using COMSOL for sensor design, combining and coupling different fields such as optics, microwave, acoustics, thermodynamics, and structural mechanics. A significant portion of the physics education and research has been facilitated using the COMSOL software products. Other than full and open competition is in accordance with FAR 13.106-1(b) and an approved Justification and Approval is on file and attached to this synopsis. The government has reasonably determined that the firm Comsol, Inc. is the only source reasonably available to satisfy the requirements of the Naval Postgraduate School. The maximum amount that can be ordered under the resultant 5-year BPA is $250,000. The BPA shall be for a period of 5-years or $250,000.00 whichever comes first. All BPA calls will firm fixed price. Payment method will be GWPC or WAWF Responses to this notice must demonstrate clear and convincing evidence that competition would be advantageous to the Government and would not hinder mission objective of the Naval Postgraduate School performance and meeting critical education and research delivery schedule. The determination not to compete this proposed contract action is solely within the discretion of the Government. Information received will normally be considered for the purposes of determining whether to conduct a competitive procurement. The Government will not be responsible for any costs incurred by responding to this notice. Please note that a BPA is not a contract. A BPA is a streamlined method for acquiring goods and services on an as-needed basis from a qualified source(s) that are readily available and services and thus eliminate the need for repetitive costly re-procurements. All calls/orders must be acknowledged by the selected vendor in order to be retained on the BPA call list. The Government will not be issuing a formal Request for Proposal (RFP) because this notice will result in a single award BPA. In addition, the Government does not intend to pay for any information provided under this notice. The Government is not obligated to notify respondents of the results of this notice. This is not a request for quotes or proposals.
