LINE 0001 AND 0002 TASK ORDER 0002 Design, develop, implement, test, deliver and install a functional and efficient Facilities Critical Infrastructure Control and Monitoring System (CICMS). This contract action was accomplished using other than competitive procedures because of the following: Statutory Authority Permitting Other Than Full and Open Competition: 10 U.S.C. 2304(b)(2) as implemented by Federal Acquisition Regulation (FAR) 6.302-5 Authorized or Required by Statute. The statutory authority for this SBIR Phase III award is 15 USC 638(r). This is an order under an existing contract that was awarded using non-competitive procedures. J&A was posted for base award N00174-10-D-0021. This is a task order under the base award and therefore J&A posting requirements have been met with the base award posting. Orders under the base award do not require a J&A. This contract action was not awarded as a fixed priced contract action because of uncertainties involved in contract performance that did not permit costs to be estimated with sufficient accuracy to use any type of fixed price contract.
